Terms of Service

1. Basic Agreement

This is an agreement between speekgeek.net (hereafter “SG”) and any individual or corporation (hereafter “the Customer”) who retains SG’s remote computer repair and maintenance service. This agreement is legally binding and sets forth the terms and conditions by which the service will be provided and the contractual obligations of both parties.

2. Accepting the Terms

In order to use SG’s services, the Customer must accept these terms. By using the services SG provides, the Customer agrees to be bound by the conditions and terms set forth in this document. The Customer must be legally allowed to enter into a contractual obligation, and thus must be of the age of majority in their country, and be of competent status to enter into a legal contract.

3. Service Charges

a. SG will provide remote diagnostic services at no cost to the Customer in order to finalize a quote for services provided, or the Customer may choose to purchase a package of services with a predetermined price. The Customer agrees to place the money required for the requested services into escrow. If the Customer is not completely satisfied with SG’s service, they may request a refund within thirty (30) days of the service being performed, as long as they are able to justify their claim, and SG is unable to remedy the cited problems. The money will then be refunded to the Customer’s credit card, debit card or PayPal account.

b. SG will attempt to repair any issues cited by the Customer; however, in a rare minority of cases SG may be unable to repair the Customer’s computer. In this case, SG is released from all liability or obligations to repair the Customer’s computer, and the Customer will receive a full refund credited to their PayPal account, credit card or debit card.

c. Though SG attempts to be as accurate as possible when preparing a quote for a customer, there may be certain cases where a quote must be revised due to unforeseen circumstances, such as when additional work is required. In these cases, the Customer has the right to opt not to purchase these additional services; however, SG then will be released from the terms of this contract, and cannot guarantee the efficacy of their services.

4. Remote Support Services

a. SG provides computer repair and maintenance via the Internet. The Customer requires an Internet connection in order to avail of SG’s services. The Customer must install an executable application on their computer in order for SG to provide assistance. The Customer agrees to allow SG unlimited license in use of the tools that already exist in the computer and agrees to allow full access to all files and applications. SG will remove any executables installed by SG on the Customer’s computer after work is complete.

b. From time to time, SG may recommend the installation of software that is not produced by or affiliated with SG. Though SG attempts to ensure that all software recommended will not result in any complications, SG cannot provide a guarantee of functionality for any third-party software; therefore, SG will not be held liable for any damage or loss resulting from the installation of third-party software. SG’s terms and conditions do not apply to any third-party software. SG does not make any representation about the services or software provided by any other party. Furthermore, the Customer agrees that SG is authorized to install, transfer, or copy data onto the Customer’s computer.

c. In some rare cases due to faulty Customer’s PC hardware SG can not complete the work or get expected results of a repair, in this case Customer has 7 days to obtain and replace the defected hardware, otherwise SG is released from the terms of this contract.

5. Customer Obligations

a. The Customer agrees that they are legally authorized to allow for repair and maintenance services to be performed on their computer. SG will not attempt to verify said authorization and cannot be held liable in cases where the Customer has violated this term.

b. The Customer should back up all their files before beginning maintenance, as there can be unforeseen circumstances which may cause file system damage. SG is not responsible for any data loss that occurs, and will not be held liable for any costs, damages, or expenses arising out of loss, corruption, or damage of data, whether the damage happens during service, or after service has been provided.

6. Privacy

SG may be required to collect some personal information from you, including phone number, e-mail address, physical address, or any other information that is relevant to the provision of services. SG will not disclose any of your personal information to any third parties without prior permission from you. However, SG may retain your personal information on record for future use by SG, or its subsidiaries, as long as it is relevant to future provision of services. SG will not disclose any information about the contents of your computer, or any other information that SG may become aware of during the course of repair.

7. Warranty

SG will always attempt to ensure that all repairs are completed successfully; however, there may be some circumstances in which problems may arise following the provision of our services. SG provides a thirty day limited warranty, beginning immediately after the support has been provided to the Customer. SG will handle each warranty request on an individual basis, and will determine whether or not warranty service can be provided. This warranty does not apply to cases where damage is caused to the Customer’s computer by viruses, adware that have been introduced to the computer at any time after the provision of SG’s services, as SG cannot be held responsible for the Customer’s actions after the conclusion of repair work.

8. On-site Services

a. As well as providing remote repair and maintenance services, SG is also able to provide service on-site. In these cases, the aforementioned terms and obligations still apply, where relevant.

b. From time to time, SG may be required to replace a hardware component within a computer to correct the functionality of said computer. If these parts fail, SG will replace them, so long as they are still covered by the original manufacturer’s warranty. SG does not provide any independent warranty for these parts, and if the original warranty provided by the manufacturer expires, SG will not be held liable for replacement.

8. Change of Terms of Service

These Terms of Service may be changed at any time without prior notice to the Customer. The Customer will still be bound by these terms, regardless of prior notice issued by SG.

LIMITATION OF LIABILITY

IN NO EVENT SHALL SG BE LIABLE TO THE CUSTOMER FOR ANY SPECIAL, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION TO LOSS OF PROFITS, LOSS OF USE OR LOSS OF DATA. SG SHALL NOT BE LIABLE FOR ANY DAMAGES CAUSED TO THE CUSTOMER UNLESS SUCH DAMAGE IS CAUSED BY THE NEGLIGENCE OR THROUGH THE INTENTION OF SG. DAMAGES TO THE CUSTOMER IN ANY ACTION AGAINST SG RELATING TO THIS AGREEMENT OR THE PERFORMANCE OF SERVICES RELATING THERETO SHALL BE LIMITED TO THE TOTAL PAYMENTS MADE BY CUSTOMER PURSUANT TO THIS AGREEMENT DURING THE CONTRACT PERIOD PRECEDING SAID BREACH.

NO ACTION REGARDLESS OF FORM ARISING OUT OF TRANSACTIONS THIS AGREEMENT MAY BE INITIATED BY EITHER PARTY MORE THAN ONE (1) YEAR AFTER THE SERVICE.
